Terms of Service

1. Acceptance

By accessing or using the LuvMe platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform.

LuvMe is a relationship training platform operated by Bad Breath Studios Inc., a corporation incorporated under the laws of Ontario, Canada. All companions are fictional AI personas, not real people. All generated images, videos, and text are AI-generated. Companion interactions are simulated and don't constitute real relationships or professional advice.

2. Eligibility

You must be at least 16 years of age or have reached the age of majority in your jurisdiction, whichever is greater, to create an account or use LuvMe. If you are under the minimum age for your jurisdiction, you may not create an account or use the service.

Subscription and Payment Age Requirement

Subscription purchases and token purchases require you to be at least 18 years of age. Users aged 16-17 may use LuvMe on the free tier only. This restriction is due to payment processor requirements (Stripe, Apple App Store, Google Play).

Age Misrepresentation

Misrepresenting your age during account creation, including providing a false date of birth, is prohibited. If we determine that your account was created with a false date of birth and you are under the minimum age for your jurisdiction, we will terminate your account and delete all associated data.

3. Account Rules

• One account per person. Creating multiple accounts is prohibited.
• You are solely responsible for maintaining the security of your account credentials.
• Account sharing is not permitted under any circumstances.
• You must not impersonate another person or entity when creating or using your account.

4. Acceptable Use

The following uses of the platform are permitted:

• Conversational interaction with your AI companion
• Generating images and video content for personal use
• Accessing premium content features (subscription required)

5. Community Conduct and Usernames

LuvMe is a community-focused platform. All users are expected to treat one another with respect in all public-facing interactions, including usernames, display names, gallery titles, adventure content, and any other user-generated text visible to others.

5.1 Username Policy

Your username is your public identity on LuvMe. The following are not permitted in usernames:

• Hate speech, slurs, or language targeting any individual or group based on race, ethnicity, gender, sexual orientation, religion, or disability
• Profanity, sexually explicit language, or references to graphic content
• Impersonation of LuvMe staff, moderators, administrators, or official accounts
• Names designed to mislead other users into believing the account holds special authority or platform privileges

Usernames that violate this policy will be automatically rejected. If a violation is discovered after creation, the username will be forcibly reset and the account may face further action.

5.2 Toxicity and Harassment

LuvMe has a zero-tolerance policy for toxicity directed at other users. This includes but is not limited to:

• Harassment, bullying, or targeted abuse through any public-facing content (gallery titles, descriptions, adventure templates)
• Posting content designed to shock, offend, or disturb other users
• Repeatedly reporting or targeting another user's content in bad faith

Violations may result in content removal, temporary suspension, or permanent account termination at our discretion.

6. Prohibited Conduct

The following activities are strictly prohibited and will result in enforcement action:

• Reverse-engineering, extracting, or attempting to extract model weights or proprietary algorithms
• Sharing generated content publicly without written permission from Bad Breath Studios Inc.
• Creating content depicting minors in any sexual context — this results in immediate permanent ban and a report to law enforcement
• Uploading reference images of real, identifiable persons without their explicit consent
• Circumventing or attempting to circumvent age verification measures
• Reselling platform access, tokens, or generated content
• Using the platform to harass, stalk, threaten, or cause harm to real persons

7. Uploaded Content

• You confirm that you hold all necessary rights to any content you upload.
• You confirm that uploaded images do not contain identifiable real persons without their explicit consent.
• You are solely liable for any violations arising from content you upload.
• Reference images are processed for the requested generation and then deleted immediately.

8. Intellectual Property

• Content generated through the platform is licensed to you for personal, non-commercial use only.
• Bad Breath Studios Inc. retains all intellectual property rights in the platform, including but not limited to AI models, algorithms, software, and user interface design.
• You may not commercially exploit, redistribute, sublicense, or publicly display generated content without prior written permission from Bad Breath Studios Inc.
• Bad Breath Studios Inc. retains the right to use anonymised and aggregated data for platform improvement.

9. Subscription and Billing

9.1 Subscription Tiers

LuvMe offers three tiers: Free, Basic, and Premium. Each tier provides different levels of access to features including daily messages, image generation, and voice calls. See our Pricing page for current tier details.

9.2 Auto-Renewal

By subscribing, you expressly consent to automatic renewal at the then-current price. You will receive advance notice before each renewal period. Paid subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You will be charged the applicable subscription fee at the beginning of each billing period.

9.3 How to Cancel

You may cancel your subscription at any time through Settings > Account > Cancel Subscription in the app, or by emailing billing@luvme.io. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.

9.4 Refunds

Refund requests are handled in accordance with our Refund Policy.

9.5 Price Changes

We will provide at least 30 days' notice via email before any price increases take effect. Continued use of the platform after the notice period constitutes acceptance of the new pricing.

10. Termination

• We may terminate your account for violations of these Terms of Service without refund.
• You may cancel your account at any time through your account settings.

11. Limitation of Liability

The platform is provided "as is" without warranties of any kind, express or implied. Bad Breath Studios Inc. does not guarantee uninterrupted service, uptime, or availability. To the maximum extent permitted by law, Bad Breath Studios Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of laws provisions.

13. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through good faith negotiation first. If negotiation fails, disputes shall be resolved through the courts of Ontario, Canada.

14. Indemnification

You agree to indemnify, defend, and hold harmless Bad Breath Studios Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or your violation of any third-party rights.

15. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Modification Notice

We reserve the right to modify these Terms of Service at any time. For material changes, we will provide at least 30 days' notice via email to the address associated with your account. Continued use of the platform after the notice period constitutes acceptance of the modified terms. If you do not agree to the modified terms, you must stop using the platform and may request account deletion.

17. Class Action Waiver

To the fullest extent permitted by applicable law, you and Bad Breath Studios Inc. each waive the right to bring or participate in a class action, collective action, or representative proceeding. Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

18. Ontario Consumer Protection

As Bad Breath Studios Inc. is incorporated in Ontario, Canada, the following rights apply under the Ontario Consumer Protection Act, 2002 (CPA):

• Cooling-Off Period: For internet agreements valued at $50 CAD or more, you have the right to cancel within 10 days of receiving a copy of the agreement, without penalty. To exercise this right, contact billing@luvme.io or cancel through Settings in the app.
• Unfair Practices: Nothing in these Terms limits your rights under Part III (Unfair Practices) of the CPA. Any representations made about the service are accurate to the best of our knowledge.
• Disclosure: This agreement constitutes the internet agreement required under Part III.1 of the CPA. A copy is available at any time at /terms.
• Refunds on Cancellation: If you cancel within the cooling-off period, all payments will be refunded within 15 days via the original payment method.

Where these Terms conflict with the CPA, the CPA prevails to the extent of the conflict.
